บริษัท โดนัทส์ แบงค็อก จำกัด และบริษัทในเครือ รวมถึงบุคคลที่เกี่ยวข้องกับการประมวลผลข้อมูลส่วนบุคคลตามคำสั่งหรือในนามของบริษัท โดนัทส์ แบงค็อก จำกัด ซึ่งต่อไปนี้จะเรียกรวมว่า “บริษัท” มุ่งมั่นที่จะปกป้องความเป็นส่วนตัวของลูกค้า ผู้ใช้บริการ คู่ค้า พันธมิตรทางธุรกิจ ผู้มาติดต่อ ไม่ว่าจะเป็นการเก็บรวบรวม ใช้ และ/หรือเปิดเผย (เรียกรวมกันว่า “การประมวลผลข้อมูล”) เพื่อให้เป็นไปตามพระราชบัญญติคุ้มครองข้อมูลส่วนบุคคล พ.ศ 2562 บริษัทจึงออกประกาศฉบับนี้เพื่อแจ้งข้อมูลแก่ท่านอันเกี่ยวกับสิทธิและหน้าที่ ตลอดจนเงื่อนไขต่างๆ ในการเก็บ รวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคล

ข้อมูลส่วนบุคคล

“ข้อมูลส่วนบุคคล” หมายถึง ข้อมูลเกี่ยวกับบุคคลซึ่งทำให้สามารถระบุตัวบุคคลนั้นได้ไม่ว่าทางตรงหรือทางอ้อม แต่ไม่รวมถึงข้อมูลของผู้ถึงแก่กรรมโดยเฉพาะ

ข้อมูลส่วนบุคคลที่บริษัทเก็บรวบรวม

ในการเก็บรวบรวม และเก็บรักษาข้อมูลส่วนบุคคล บริษัทจะใช้วิธีการที่ชอบด้วยกฎหมายและจำกัดเพียงเท่าที่จำเป็นตามวัตถุประสงค์การดำเนินงานของบริษัท อันประกอบด้วย

ข้อมูลส่วนบุคคล เช่น ชื่อ-นามสกุล, วันเดือนปีเกิด, อายุ, สัญชาติ, เลขประจำตัวประชาชน, ลายมือชื่อ
ข้อมูลสำหรับการติดต่อ เช่น ที่อยู่, หมายเลขโทรศัพท์, อีเมล
ข้อมูลทางการเงิน เช่น สำเนาสมุดบัญชีธนาคาร, เลขบัตรเครดิต
ข้อมูลที่ได้จากการเก็บรวบรวมของบริษัท หรือระบบอัตโนมัติจากอุปกรณ์ต่างๆ ของบริษัท เช่น หมายเลข IP Address, Cookie, พฤติกรรมการใช้บริการ, ประวัติการสั่งซื้อ, ภาพถ่าย, ภาพและ/หรือวิดีทัศน์จากกล้องวงจรปิด

โดยบริษัทจะดำเนินการเก็บรวบรวมข้อมูลส่วนบุคคลเมื่อได้รับความยินยอมจากเจ้าของข้อมูลส่วนบุคคลก่อน ยกเว้นในกรณีดังต่อไปนี้

เพื่อปฏิบัติตามสัญญา กรณีการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลเพื่อความจำเป็นต่อการให้บริการหรือปฏิบัติตามสัญญาระหว่างเจ้าของข้อมูลและบริษัท
เพื่อป้องกันหรือระงับอันตรายต่อชีวิต ร่างกาย หรือสุขภาพ
เพื่อปฏิบัติตามกฎหมาย
เพื่อผลประโยชน์อันชอบโดยกฎหมายของบริษัท กรณีมีความจำเป็นเพื่อประโยชน์อันชอบธรรมในการดำเนินงานของบริษัท โดยบริษัทจะพิจารณาถึงสิทธิของเจ้าของข้อมูลเป็นสำคัญ เช่น เพื่อป้องกันการฉ้อโกง การรักษาความปลอดภัยในระบบเครือข่าย การปกป้องสิทธิเสรีภาพ และประโยชน์ของเจ้าของข้อมูล เป็นต้น
เพื่อการศึกษาวิจัยหรือสถิติ กรณีที่มีการจัดทำเอกสารประวัติศาสตร์หรือจดหมายเหตุเพื่อประโยชน์สาธารณะหรือที่เกี่ยวกับการศึกษาวิจัยหรือสถิติซึ่งได้จัดให้มีมาตรการปกป้องที่เหมาะสมเพื่อคุ้มครองสิทธิ และเสรีภาพของเจ้าของข้อมูล
เพื่อปฏิบัติภารกิจของรัฐ กรณีที่ความจำเป็นต่อการปฏิบัติตามภารกิจเพื่อประโยชน์สาธารณะ หรือ การปฏิบัติหน้าที่ตามอำนาจรัฐที่บริษัทได้รับมอบหมาย

แหล่งที่มาของข้อมูล

ได้รับจากเจ้าของข้อมูลโดยตรงที่ท่านได้ให้ไว้ในกิจกรรมต่างๆ เช่น เข้าร่วมกิจกรรมส่งเสริมการขาย สมัครสมาชิก สมัครรับข้อมูลข่าวสาร เข้าร่วมกิจกรรมทางการตลาด เก็บข้อมูลสำหรับผู้ติดต่อสำนักงานหรือสตูดิโด
ข้อมูลจากระบบอัตโนมัติ เช่น ภาพและ/หรือวิดีทัศน์จากกล้องวงจรปิด
ข้อมูลจากแหล่งอื่น เช่น ข้อมูลสาธารณะ หน่วยงานพันธมิตร บริษัทในเครือ

วัตถุประสงค์ในการประมวลผลข้อมูลส่วนบุคคล

บริษัทอาจนำเข้าข้อมูลส่วนบุคคลไปใช้ตามวัตถุประสงค์ดังต่อไปนี้หรือตามวัตถุประสงค์อื่นๆ ที่แจ้งขณะเก็บรวบรวมข้อมูลหรือที่ท่านได้ให้ความยินยอมหลังจากบริษัทดำเนินการเก็บข้อมูลไปแล้ว

เพื่อเข้าทำสัญญา หรือปฏิบัติหน้าที่ตามสัญญาระหว่างบริษัทกับเจ้าของข้อมูล หรือปฏิบัติหน้าที่ตามสัญญาระหว่างบริษัทกับบุคคลภายนอกเพื่อประโยชน์ของเจ้าของข้อมูล
เพื่อตอบคำถามและให้ความช่วยเหลือแก่เจ้าของข้อมูล
เพื่อพัฒนาและปรับปรุงสินค้า ผลิตภัณฑ์ และบริการของบริษัทให้ตอบสนองต่อความต้องการของเจ้าของข้อมูลมากยิ่งขึ้น
เพื่อให้ข้อมูลและแนะนำสินค้า ผลิตภัณฑ์ การบริการ และ/หรือประชาสัมพันธ์ทางการตลาด รายการส่งเสริมการขาย หรือสิทธิประโยชน์ผ่านช่องทางการติดต่อที่ได้รับจากเจ้าของข้อมูล ตามที่เจ้าของข้อมูลได้ให้คำยินยอม
เพื่อสำรวจความคิดเห็น วิเคราะห์ การทำวิจัย และจัดทำข้อมูลทางสถิติ เพื่อใช้ทางการตลาด หรือ การพัฒนาและปรับปรุงการดำเนินกิจการของบริษัท ตามที่เจ้าของข้อมูลได้ให้คำยินยอม
เพื่อประโยชน์ในการบริการจัดการงานหรือดำเนินงานภายในของบริษัทที่จำเป็นภายใต้ประโยชน์โดยชอบด้วยกฎหมาย
เพื่อตรวจสอบ กำกับดูแล และรักษาความปลอดภัยบริเวณอาคารหรือสถานที่ของบริษัท
เพื่อการปฏิบัติตามกฎหมายที่เกี่ยวข้องกับการดำเนินงานของบริษัท เช่น การหักภาษี ณ ที่จ่าย
เพื่อให้ข้อมูลแก่หน่วยงานของรัฐที่มีอำนาจตามกฎหมายตามที่หน่วยงานภาครัฐร้องขอ เช่น สำนักงานตำรวจแห่งชาติ สำนักงานป้องกันและปราบปรามการฟอกเงิน กรมสรรพากร ศาล
เพื่อดำเนินกิจกรรมใดๆ ทางบัญชีและการเงิน เช่น การตรวจสอบบัญชี การแจ้งและเรียกเก็บหนี้ การใช้สิทธิสวัสดิการต่างๆ ภาษี และหลักฐานการดำเนินธุรกรรมต่างๆ ที่กฎหมายกำหนด
เพื่อประโยชน์อันชอบด้วยกฎหมายของบริษัท เช่น การบันทึกเสียงการร้องเรียนผ่านระบบ Call Center
เพื่อใช้ในการสอบสวนและปฏิบัติตามกฎหมาย ข้อบังคับ ระเบียบ หรือหน้าที่ตามกฎหมายของบริษัท
ใช้ข้อมูลในการยืนยันตัวตนของลูกค้า
วัตถุประสงค์อื่นๆ ที่ได้รับคำยินยอมชัดแจ้งจากท่าน

การส่งต่อและเปิดเผยข้อมูลส่วนบุคคล

บริษัทจะไม่เปิดเผยและส่งต่อข้อมูลส่วนบุคคลของท่านไปยังหน่วยงานภายนอก เว้นแต่ได้รับคำยินยอมชัดแจ้งจากท่าน หรือเป็นไปตามกรณีดังต่อไปนี้

เพื่อบรรลุวัตถุประสงค์ตามที่ระบุในประกาศความเป็นส่วนตัวฉบับนี้ บริษัทอาจจำเป็นต้องเปิดเผยหรือแบ่งปันข้อมูลเฉพาะเท่าที่จำเป็นแก่คู่ค้า ผู้ให้บริการ หรือหน่วยงานภายนอก เช่น การให้บริการด้านเทคโนโลยีสารสนเทศ บริการบันทึกข้อมูล บริการตรวจสอบบัญชี บริการชำระเงิน บริการรับส่งไปรษณีย์ บริการรับส่งพัสดุ บริการจัดพิมพ์ บริการประกันภัย บริการวิเคราะห์ข้อมูล บริการทำการวิจัย การทำการตลาด หรือบริการอื่นใดที่อาจเป็นประโยชน์ต่อท่าน หรือเกี่ยวข้องกับการดำเนินธุรกิจของบริษัท เป็นต้น โดยบริษัทจะทำข้อตกลงการประมวลผลข้อมูลส่วนบุคคลตามที่กฎหมายกำหนด
บริษัทอาจเปิดเผยหรือแบ่งปันข้อมูลส่วนบุคคลให้แก่บริการในเครือ โดยจะเป็นการประมวลผลข้อมูลภายใต้วัตถุประสงค์ที่ระบุในนโยบายความเป็นส่วนตัวฉบับนี้เท่านั้น
กฎหมายหรือกระบวนการทางกฎหมายบังคับให้เปิดเผยข้อมูล หรือเปิดเผยต่อเจ้าพนักงาน เจ้าหน้าที่รัฐ หรือหน่วยงานที่มีอำนาจเพื่อปฏิบัติตามคำสั่งหรือคำขอที่ชอบด้วยกฎหมาย

การถ่ายโอนหรือส่งต่อข้อมูลไปยังต่างประเทศ

บริษัทอาจจะส่งหรือโอนข้อมูลส่วนบุคคลไปยังต่างประเทศ โดยจะทำให้แน่ใจว่าประเทศปลายทางหรือหน่วยงานปลายทางมีมาตรฐานการคุ้มครองข้อมูลส่วนบุคคลที่เพียงพอ

การปกป้องข้อมูลส่วนบุคคล

บริษัทจะใช้มาตรการทางเทคนิค และการบริหารจัดการที่เหมาะสมเพื่อป้องกันและรักษาความปลอดภัยของข้อมูลส่วนบุคคลของท่าน โดยมีการเข้ารหัสสำหรับการส่งข้อมูลผ่านเครือข่ายอินเตอร์เน็ตและควบคุมการเข้าถึงข้อมูลส่วนบุคคลของท่านเฉพาะผู้ที่เกี่ยวข้องทั้งในส่วนของข้อมูลที่จัดเก็บในรูปแบบเอกสารและอิเล็กทรอนิกส์

ระยะเวลาในการจัดเก็บข้อมูล

บริษัทจะเก็บรวบรวมข้อมูลส่วนบุคคลของท่านไว้ตลอดระยะเวลาตราบเท่าที่จำเป็นต่อการประมวลผลตามวัตถุประสงค์ในประกาศฉบับนี้เท่านั้น เว้นแต่มีความจำเป็นต้องเก็บข้อมูลส่วนบุคคลไว้ด้วยเหตุอื่นใด เช่น เพื่อปฏิบัติตามกฎหมายหรือการตรวจสอบกรณีการเกิดข้อพิพาท บริษัทอาจมีความจำเป็นต้องเก็บข้อมูลไว้เป็นระยะเวลาเกินกว่าที่ระบุ

การเปลี่ยนแปลงนโยบายข้อมูลส่วนบุคคล

บริษัทอาจแก้ไขเพิ่มเติมนโยบายความเป็นส่วนบุคคลโดยจะประกาศบนเว็บไซต์ของบริษัท และช่องทางอื่นๆ พร้อมระบุวันที่แก้ไขเพิ่มเติมครั้งล่าสุด บริษัทแนะนำให้ท่านตรวจสอบนโยบายนี้เป็นประจำ โดยการที่ใช้บริการทางเว็บไซต์ของบริษัทต่อไปหลังจากที่มีการเปลี่ยนแปลงประกาศเกี่ยวกับความเป็นส่วนตัวจะถือว่าท่านยอมรับนโยบายที่เปลี่ยนแปลงนั้นแล้ว

สิทธิของเจ้าของข้อมูลส่วนบุคคล

ท่านสามารถขอใช้สิทธิต่างๆ ตามที่กฎหมายกำหนด และตามที่ระบุไว้ในนโยบายฉบับนี้ได้ ดังต่อไปนี้

สิทธิในการขอเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคล หรือขอให้เปิดเผยแหล่งที่มาของข้อมูลส่วนบุคคลของพนักงาน (Right of access)
สิทธิในการขอแก้ไขข้อมูลดังกล่าวให้เป็นปัจจุบันและถูกต้อง (Right to rectification)
สิทธิในการขอรับข้อมูลส่วนบุคคลหรือขอให้ส่งหรือโอนข้อมูลส่วนบุคคลไปยังผู้ควบคุมข้อมูลส่วนบุคคลอื่น (Right to data portability) ในกรณีที่บริษัทได้ทำให้ข้อมูลส่วนบุคคลนั้นอยู่รูปแบบที่สามารถอ่านหรือใช้งานโดยทั่วไปด้วยเครื่องหมายหรืออุปกรณ์ที่ทำงานโดยอัตโนมัติและสามารถใช้หรือเปิดเผยข้อมูลส่วนบุคคลได้ด้วยวิธีการอัตโนมัติ
สิทธิในการขอลบหรือทำลายหรือทำให้ข้อมูลส่วนบุคคลเป็นข้อมูลส่วนที่ไม่สามารถระบุตัวบุคคลได้ (Right to erasure) เมื่อข้อมูลนั้นหมดความจำเป็นหรือเมื่อเจ้าของข้อมูลส่วนบุคคลถอนความยินยอม
สิทธิในการขอให้ระงับการใช้งานข้อมูลส่วนบุคคล (Right torestriction of processing) ในกรณีเมื่อเป็นข้อมูลส่วนบุคคลที่ต้องลบหรือเมื่อข้อมูลดังกล่าวหมดความจำเป็น
สิทธิในการถอนความยินยอม (Right to withdraw consent) ในการประมวลผลข้อมูลที่ท่านเคยให้ไว้
สิทธิในการขอคัดค้าน (Right to lodge complaint)

หากท่านมีความกังวลหรือมีข้อสงสัยเพิ่มเติมเกี่ยวแนวทางปฏิบัติของบริษัทเกี่ยวกับข้อมูลส่วนบุคคลของบริษัท โปรดติดต่อบริษัทโดยใช้รายละเอียดการติดต่อตามข้อ 9. ของนโยบายความเป็นส่วนบุคคลฉบับนี้ ทั้งนี้ ในกรณีที่มีเหตุการณ์ให้เชื่อได้ว่าบริษัทได้ทำการฝ่าฝืนหรือไม่ปฏิบัติตามกฎหมายว่าด้วยการคุ้มครองข้อมูลส่วนบุคคล ท่านมีสิทธิยื่นข้อร้องเรียนต่อคณะกรรมการคุ้มครองข้อมูลส่วนบุคคล ตามระเบียบและวิธีการตามที่กฎหมายว่าด้วยการคุ้มครองข้อมูลส่วนบุคคลกำหนด

ทั้งนี้ บริษัทขอสงวนสิทธิในการพิจารณาร้องขอใช้สิทธิของท่านและดำเนินการตามที่กฎหมายว่าด้วยการคุ้มครองข้อมูลส่วนบุคคลกำหนด
